RULE CHANGES FOR CONSIDERATION BY MEMBERS:

Background: Due to the requirement to align Division Representative to the Board Elections with the Direct Voting System, MTAQ has taken the opportunity to conduct an extensive overall review of our current Rules.

At its meeting held 23 May 2024 the MTAQ Board resolved unanimously to recommend the changes to members for approval at a General Meeting.

Assessment Summary:

  • The alignment to the Direct Voting System also requires changes to definitions and clarity of the process throughout the Rules.
  • Voting at meetings and Voting at Elections cannot be covered by the same process and have separate requirements the changes and addition of a new rule provide clarity.
  • Alignment of proxies to the members of the meetings.
  • Clarify for definitions for the positions of:
  • Division Representatives and Division Representatives Elect
  • Alternate Division Representatives and Alternate Division Representatives Elect
  • Clarify timing of Elected Office Holders taking up positions
  • Remove Alternate District Representative, Division Alternate Representatives are clearly linked to Vice Chair positions. There is no additional roles under District Representatives to perform this function
  • Detail nomination procedure applicable to each form of Election

RECOMMENDATION: Approve the Rule changes as tabled and authorise for the application for amendment of Rules to be drafted, signed and lodged with the Fair Work Commission
